Terms of Service

1. About these terms
These Terms of Service ("Terms") form a binding agreement between you and Aster Board ("Aster Board", "we", "us", "our") governing your use of the asterboard.com website, progressive web application, TV and remote interfaces, and related APIs (collectively, the "Service"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to that organisation.
2. Eligibility
You must be at least 13 years old (16 in the European Economic Area and the United Kingdom) to use the Service. If you are below the age of majority in your jurisdiction, a parent or legal guardian must accept these Terms on your behalf.
3. Early access
The Service is currently offered as early access. During this period:
- All features are available to signed-in users at no charge.
- We may add, change, suspend or remove features without notice in order to fix bugs, address security issues or improve quality.
- We may collect additional diagnostic information necessary to stabilise the Service. Personal data is handled in accordance with our Privacy Policy.
- The Service is provided AS IS, with the additional disclaimers in sections 13–14 below.
We will give you reasonable advance notice before early access ends or before any pricing tier becomes paid for new sign-ups.
4. Accounts
You sign in through our authentication provider (Clerk). You are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account. Tell us immediately at [email protected] if you believe your account has been compromised.
5. Acceptable use
You agree not to:
- use the Service in any way that violates applicable law, regulation, or third-party rights, including export control, sanctions, intellectual property, privacy, anti-spam, defamation, and consumer protection laws;
- display, distribute or transmit unlawful, harassing, hateful, sexually explicit, or violent content, or content that infringes another person's rights;
- attempt to gain unauthorised access to any account, server, network, or data, including by probing or testing the vulnerability of the Service without our written permission;
- scrape, crawl, mass-download, or otherwise extract content from the Service in ways that exceed normal use, or use it to train machine-learning models without our written permission;
- interfere with or overload the Service, including by bypassing rate limits, retries, or quota controls;
- use the Service to send unsolicited communications or to distribute malware.
We may suspend or terminate access if you breach these rules.
6. Your content
You retain ownership of the cards, presets, decks, memos, playlists, campaigns, reminders and other content you create through the Service (your "Content"). You grant Aster Board a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, back up, and display your Content solely as necessary to provide the Service to you and to comply with our legal obligations. You are responsible for the Content you create and for ensuring you have the rights to use it.
7. Curated content
The Service displays content from owner-curated collections (wisdom, motivation, vocabulary, did-you-know, reflections, ESL) and from public APIs (NASA Astronomy Picture of the Day, MTA subway arrivals, Open-Meteo weather). Third-party content is provided AS IS and remains subject to the terms of its source. Some factual content is still being reviewed item by item, and we do not warrant its accuracy.
8. Commercial license
If you use the Service to display content in a public-facing commercial setting (for example, a hotel lobby, restaurant, retail location, gym, or office) you must purchase a Commercial License ($49.99/month for a single business location) once paid plans are enabled. The Commercial License authorises one business location and allows you to display your own advertising or third-party advertising. 9. Subscriptions, billing and refunds
Paid subscriptions (Pro and Commercial) renew automatically until you cancel. You can cancel any time from the Account page; the cancellation takes effect at the end of the current billing period. Fees are inclusive of applicable taxes only where local law requires. Where required by consumer protection law (for example the EU Consumer Rights Directive), you have a 14-day right of withdrawal from new digital service contracts; by starting to use a paid feature within that 14-day window you expressly request immediate performance and waive that right to the extent permitted by law. Other refund requests are handled on a case-by-case basis at our discretion.
10. Intellectual property
Aster Board, the Aster Board name and flower mark, the split-flap animation engine, the curation and rotation algorithms, the interface design, and all related code are owned by Aster Board or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except as expressly granted, no rights in the Service are transferred to you. Open-source components are provided under their respective licenses.
11. Feedback
If you send us feedback, suggestions, or feature requests, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use that feedback to improve the Service, with no obligation of attribution or compensation.
12. Suspension and termination
You may stop using the Service at any time and delete your account from the Account page. We may suspend or terminate your access if you materially breach these Terms, if your use creates a security or legal risk, or if we are required to do so by law. We will give you reasonable notice where practicable. On termination we will delete your personal data in accordance with our Privacy Policy.
13. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided AS IS and AS AVAILABLE, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy of content. We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, in which case the above exclusions apply only to the extent permitted.
14. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Aster Board, its directors, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, use, goodwill or other intangible losses, arising out of or related to your use of or inability to use the Service. Our aggregate liability for direct damages under these Terms is limited to the greater of (a) the amount you paid Aster Board for the Service in the twelve (12) months immediately before the event giving rise to the claim, or (b) USD $50. Nothing in these Terms limits liability that cannot be limited by law (including, in some jurisdictions, liability for fraud, gross negligence, death or personal injury caused by negligence, or your statutory consumer rights).
15. Indemnification
To the extent permitted by applicable law, you will defend and indemnify Aster Board against any third-party claim arising out of (a) your Content, (b) your use of the Service in breach of these Terms or applicable law, or (c) your infringement of any third party's rights. We will notify you promptly of any such claim and cooperate reasonably in the defence.
16. Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. The state and federal courts located in New York County, New York will have exclusive jurisdiction over disputes arising out of these Terms, except that you may bring an action in small claims court where eligible.
Consumers in the EEA, UK and Switzerland.Nothing in this section deprives you of the protection of the mandatory consumer-protection rules of the country where you have your habitual residence; you may also bring proceedings in the courts of that country. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
17. Export control and sanctions
You may not use, export, or re-export the Service in violation of US export control, sanctions, or anti-boycott laws, or any equivalent laws of your jurisdiction. By using the Service you represent that you are not located in, and are not a national or resident of, any country subject to comprehensive US sanctions, and that you are not on any restricted-party list maintained by a competent authority.
18. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Effective" date at the top of this page and, where required, notify you in-app or by email before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
19. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Aster Board regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
